Florida SB 360 Update – Permit Extensions

The Government Affairs page on the PCBA website contains two links to assist you in requesting permit extensions under SB 360.  The first link takes you to a notice created by FHBA to help you understand who qualifies for the extension and what you must do to receive the extension.  The second document is a DEP email explaining how the Department will implement the extension and what permits are eligible.

The most important facts to remember regarding the extension are the following:

1) You must notify the government agency who issued you the permit by December 31st of this year.  IT IS NOT AUTOMATICALLY APPLIED TO YOU!

2) This is a NOTICE not a request.  The notice must be in writing.  As long as you meet the qualifications.  The permit must expire between September 1, 2008 and January 1, 2012.

3) It is recommended that you also record a document in public records establishing that you used the two year permit extension, especially for DRI DO phasing or buildout extensions

4) The extension of state permits is limited to those issued under 373 Part IV such as ERP permits. (See DEP email for clarification)

5) The local government permits eligible for an extension are more open ended than the extension of state permits.
